Canada: Some Foreign-Born Descendants Can Now Claim Citizenship From Birth
Canada has clarified its citizenship-by-descent rules, saying some people born outside the country may now be recognised as Canadian citizens from birth if they can establish an unbroken line of descent from a Canadian parent or direct ancestor.
The clarification, published on Friday by Canadian immigration authorities through CanadaVisa’s X account, explains that citizenship claims are determined by a direct family line and the citizenship status of each generation at the time of birth.
Under the rules, citizenship can only be passed through parents, grandparents or other direct ancestors. Relatives such as aunts, uncles, cousins or in-laws cannot pass on Canadian citizenship by descent.
According to the authorities, eligibility depends on whether a parent was already a Canadian citizen when the child was born.
“The Citizenship Act recognizes a person born abroad to a parent who was a citizen at the time of the birth,” the post stated.
The clarification follows legal changes introduced after court challenges argued that previous restrictions unfairly denied some descendants of Canadians citizenship recognition.
As a result, some individuals who were previously considered ineligible may now be recognised as Canadian citizens from birth, instead of receiving citizenship only after submitting an application.
Immigration authorities, however, stressed that citizenship cannot usually be passed to a child if the parent became a Canadian citizen after the child’s birth.
“If your parent was granted citizenship after you were born, that citizenship does not pass to you through descent,” the post added.
The authorities also noted that marrying a Canadian citizen does not automatically confer citizenship, while adopted children are processed under separate legal provisions.
Applicants seeking to confirm their eligibility are advised to identify the earliest Canadian-born ancestor in their direct family line and trace citizenship through each generation.
For those who qualify, the citizenship certificate serves only as official confirmation of a status they may already have held since birth.
